Terms and conditions

Alex Gurau Photography refers to the trading name of Alex Gurau Photography.

Client – is the person or organisation to whom the invoice is addressed (whether or not the Client is acting for a third party) or any customer purchasing prints or digital images.

Photographs – means all photographic material supplied by Alex Gurau Photography. This includes transparencies, negatives, prints, digital files, digital scan, digital image, design, artwork, montage or any other item which may be supplied for the purposes of reproduction.

Reproduction – includes any form of publication or copying of the whole or part of any Photographs and whether or not altered by printing, photography, projection (whether or not to an audience) scanning, artist’s reference, artist’s illustration, layout or presentation, electronic or mechanical reproduction or storage by any other means.

The entire copyright in the Photographs is retained by Alex Gurau Photography at all times throughout the world.

Alex Gurau Photography supplies the technical and artistic ability to illustrate an idea photographically and sells the right to reproduce those photographs in a given context. No property or copyright in any photographs shall pass to the Client whether on its submission or on Alex Gurau Photography’s grant of reproduction rights in respect thereof.

Any reproduction rights granted are by way of licence and no partial or other assignment of copyright shall be implied.

Ownership of Materials – Title to all Photographs remains the property of Alex Gurau Photography. Images will be licensed for use without a time restriction. Should images be licensed for use for a specified period, the client will be notified in writing in the photographic proposal. When the License to Use has expired, the images should be returned to the Photographer and a written undertaking given that all digital files have been destroyed. The Client is expected to comply with this requirement within 30 days of expiration of the License to Use. The Photographer reserves the right to make an additional charge for continued use after this period.

Alex Gurau Photography asserts both the moral right to be identified as the author of his work as well as the right to a credit is asserted in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988.

Permission to use images immediately is granted, however, this permission will be immediately revoked if payment of the invoice is not made by the timescale stated on the invoice.

Should The License to Use the images be withdrawn by Alex Gurau Photography, the Client must cease using the images and all printed literature must be withdrawn from use.

Reproduction rights (if granted) are strictly limited to the use and period of time specified on Alex Gurau Photography’s invoice. An agreement must be reached with Alex Gurau Photography before the frames are to be used for a different purpose or after the licence to use has expired.

Reproduction rights are not issued exclusively to the Client except when specified on the invoice.

Reproduction rights granted are personal to the Client and may not be assigned, nor may any picture submitted to the Client be loaned or transferred to third parties save for the purpose of the exercise by the Client of such reproduction rights.

Any reproduction rights granted are by way of licence and no partial or other assignment of copyright shall be implied.

Alex Gurau Photography reserves the right to refuse to supply or grant a reproduction licence to a third party when requested to do so by the Client.

The Client will be required to confirm via e-mail or phone the acceptance of a quotation provided by Alex Gurau Photography, which also indicates their acceptance of these Terms and Conditions.

Once the Client has made a booking for a specific time and date and this date/time has been Confirmed, Alex Gurau Photography will not accept any other work from other clients for those times and dates.

As a result, once a booking is Confirmed, if it is subsequently cancelled, a cancellation fee will not be charged, however the Client will have to rebook another date and time and confirm via email that the next chosen timeframe will not be cancelled again.

Alex Gurau Photography will keep confidential and will not disclose to any third parties or make use of information communicated to them in confidence for the purposes of the photography, save as may be reasonably necessary to enable Alex Gurau Photography to carry out his obligations in relation to the commission.

The Client will first receive a small sized, watermarked copies of your selected frames either through a protected photo album on my website, a fast-shared link (which is available to download within 7 days) or physically, on a disk or on a flash drive.

From here on there are two options the Client may have and they are very simple. Looking at his samples, the Client will let Alex Gurau Photography know the prefered frames.
In most cases, Alex Photography chooses the best selection for the Client.

Alex Gurau Photography  will endeavour to put the Client in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.

In the event of cancellation by Alex Gurau Photography, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.

The shoot will be arranged on date(s) mutually agreed. During the shoot the Alex Gurau Photography will take account of the Client’s reasonable instructions in respect of the shoot.
If the Client is not present during the shoot then the Photographer’s interpretation of the brief shall be deemed acceptable.

Overtime and antisocial hours (for daily hire or unpredicted extra time)

A normal day is up to 9 hours (including 1 hour for lunch) between 9am and 6pm.

Any hours worked outside a normal day (“Antisocial Hours”) will incur additional overtime fees for the Photographer, crew and facilities.

Alex Gurau Photography’s additional hourly overtime fees are:

  • Between 6 PM and 10 PM – 1500 Kč (59 Euro) per hour.
  • Between 10pm and 9am – 2500 Kč (98 Euro) per hour.
  • In addition, the Client must provide the minimum necessary, as in hydration and meal or accommodation.
